A proactive FMLA self-audit is one of the most cost-effective compliance investments an organization can make. FMLA violations are among the most frequently litigated employment claims, with back pay, reinstatement, liquidated damages, and attorney fees all potentially at stake. The DOL's Wage and Hour Division investigates FMLA complaints regularly, and a single employee complaint can trigger a comprehensive audit of an organization's entire FMLA administration program. An internal self-audit allows HR to identify and correct compliance gaps before the DOL or a plaintiff's attorney does—on the organization's timeline and without the adversarial pressure of an external investigation. Self-audits also uncover systemic issues—like managers who consistently fail to notify HR of potential FMLA situations, or policies that inadvertently penalize employees for protected absences—that wouldn't surface through individual case review alone. Organizations that audit regularly develop stronger FMLA administration practices, experience fewer disputes, and build the documentation foundation needed to defend against claims when they do arise. The cost of a thorough internal audit is a fraction of the cost of a single FMLA lawsuit.
DOL Wage and Hour Division investigators conducting FMLA investigations have a well-established focus list that HR professionals can use to guide their self-audit priorities. Investigators typically examine whether the employer's FMLA policy is current, clearly written, and consistent with regulatory requirements; whether required notices (Eligibility Notice WH-381, Designation Notice WH-382) were provided within regulatory timeframes for each leave event; whether leave was properly designated upon receiving sufficient information—even without a formal employee request; whether medical certification requirements were administered consistently and lawfully; whether leave was tracked and charged accurately, particularly for intermittent leave; whether employees were restored to the same or equivalent position upon return; and whether any adverse employment actions taken near or after FMLA leave are supported by documentation demonstrating a non-FMLA reason. Investigators also interview employees to identify discrepancies between the employer's records and employees' recollections, making accurate contemporaneous documentation of every step in the FMLA process critical. Organizations that can produce complete, timely documentation for every leave event are in a dramatically stronger position than those relying on after-the-fact reconstruction.
FMLA abuse—where employees use protected leave for non-qualifying purposes—is a legitimate concern for employers, but addressing it requires careful, legally sound strategies that do not chill protected leave use or expose the organization to retaliation claims. Common patterns of potential abuse include: intermittent leave absences that consistently fall on Mondays and Fridays (suggesting pattern abuse around weekends); leave taken immediately after denial of a vacation request; and employees who are observed engaging in activities inconsistent with their medical certification while on leave. Employers have several legitimate tools available. Medical recertification may be requested every 30 days or sooner if the employee's pattern of absences is significantly different from what the medical certification describes. Second or third medical opinions may be requested at the employer's expense. If an employee is suspected of misrepresenting their condition, employers may engage licensed investigators for discreet surveillance in public settings, following strict legal protocols. Importantly, confronting suspected abusers directly without supporting evidence—or disciplining employees based on attendance points that include FMLA absences—creates significant legal risk. Any action taken in response to suspected abuse must be well-documented, proportionate, and grounded in objective evidence.
An effective FMLA self-audit should systematically evaluate every component of the organization's leave administration program against the regulatory requirements of the FMLA and applicable state leave laws. Key audit elements include: policy review—is the FMLA policy current, posted appropriately in the employee handbook and workplace, and consistent with current DOL regulations; notice compliance—were Eligibility Notices (WH-381) and Designation Notices (WH-382) issued within five business days for every leave event in the review period; certification practice—were medical certifications requested consistently, returned within the regulatory timeframe, and acted upon appropriately; leave tracking—is intermittent leave tracked accurately and reconciled against medical certifications; recordkeeping—are medical records maintained in confidential files separate from personnel files and retained for the required three-year period; reinstatement review—were all returning employees restored to the same or equivalent position with all required compensation and benefits; and adverse action analysis—can every adverse employment action taken within six months of an FMLA leave be supported by documented, pre-existing non-FMLA reasons. The audit should produce a written report with findings and a prioritized corrective action plan.
Manager training is one of the most critical and most frequently neglected components of an FMLA compliance program. Managers are the first line of contact with employees experiencing health issues or family situations that may trigger FMLA eligibility, but without proper training, they often make well-intentioned mistakes that create significant legal exposure. Effective FMLA manager training should cover: how to recognize a potentially FMLA-qualifying absence (employees need not say the words FMLA—any mention of a serious health condition, surgery, hospitalization, or family care situation should alert the manager); the critical obligation to notify HR immediately when an FMLA-qualifying situation is suspected rather than managing leave independently; what the manager can and cannot say to employees about their leave; how to handle intermittent absences without penalizing employees for protected leave in attendance or performance metrics; and how to manage workflow and coverage during leave without creating conditions that pressure employees to forego protected leave. Managers who understand their notification obligation—and who feel supported rather than abandoned by HR in leave administration—are an organization's most effective first line of FMLA compliance defense.
