Properly administering FMLA requires methodical attention to detail to avoid technical violations of the Act. This includes understanding the interplay between other employment laws, paid leaves, company benefits, and company policies. It also requires an understanding of the timing of FMLA notice requirements. This session will cover how FMLA interacts or runs concurrently with company paid time off benefits, workers’ compensation claims, group health insurance, STD and LTD, the American’s with Disabilities Act (ADA), and wage and hour compliance, among others. The presentation will provide insight for employers on how to evaluate an FMLA leave request in conjunction with the other benefits and laws at play and provide helpful tips on managing complex FMLA requests.

Learning Objectives:

  • Identify when a leave request triggers coverage under the FMLA.
  • Identify when an employee’s request triggers coverage under the FMLA and another law.
  • Wage and hour compliance related to FMLA leave.
  • Minimize risk of FMLA retaliation claims.
  • Tips for managing time off under your company’s policies and FMLA.
