Following the enactment of the ADAAA, the law which made sweeping changes to the ADA, employers were required to refocus their ADA compliance efforts on the interactive process under the ADA- the sometimes lengthy dialogue with employees – to determine whether there is any reasonable accommodation which would allow the employee to perform the essential functions of the employee’s job. Since the enactment of the ADAAA, the EEOC and the courts have continued to redefine the full extent of the rights and duties of both employees and employers. This webinar will assist employers in understanding those obligations, and provide practical ways in which employers can reduce risk, increase legal compliance and better manage the productivity of their employees.

Your Benefits For Attending:

  • The ADA – a law requiring a particular process for all employees that can result in different outcomes for each individual employee.
  • The Supreme Court Cases limiting the definition of disability.
  • The ADAAA’s as a reaction to the Supreme Court Cases
  • The Interactive Process and Why It is More Important Than Ever
  • What an Employer Must Show to Establish Undue Hardship
  • Interaction with FMLA, WC, SSB and private disability benefits plans.
  • Exercises designed to teach the interactive process

Great speaker - great information. Very useful examples. Took a challenging topic and made it much more clear.

The presenter did a great job covering the information. However, there was so much to present in 1.5 hours that (1) she had to continuously talk with little or not pauses (2) gave little time for me as the audience to process what she just mentioned. She knew what she was presenting...but did not give enough time for the audience to absorb the information before moving to the next slide.

"Add in additional real-life scenarios that HR professionals are faced with. A combo of ADA/PDA/WC, for example."

"I feel like she rushed through the information. She kept stumbling with her words. It was quite distracting when she kept taking drinks of whatever she was drinking. Don't know if she wasn't feeling well or what."

"It was disappointing to pay, attend, and then have the slides read to us as the presentation. Additionally, the presentation did not cover the NYC cooperative dialogue law which we had hoped would have been covered."

Excellent. This seminar focused on FMLA and it would be helpful to also have a presentation on CFRA
