Following the enactment of the ADAAA, the law which made sweeping changes to the ADA, employers were required to refocus their ADA compliance efforts on the interactive process under the ADA- the sometimes lengthy dialogue with employees – to determine whether there is any reasonable accommodation which would allow the employee to perform the essential functions of the employee’s job. Since the enactment of the ADAAA, the EEOC and the courts have continued to redefine the full extent of the rights and duties of both employees and employers. This webinar will assist employers in understanding those obligations, and provide practical ways in which employers can reduce risk, increase legal compliance and better manage the productivity of their employees.

I would say that only three items from the agenda were actually covered: 1.Special concerns related to intermittent (reduced-schedule) FMLA leave 2.At what point should termination be considered 3.Learn proper techniques for investigating FMLA leave abuse The following items were either skipped or glossed over: -Using job descriptions to curb FMLA abuse -What paperwork is required… and allowed -What disciplinary actions you can and should use -How to establish effective policies for employees on leave Overall I felt as though the goal of the presentation was to justify termination rather than truly identifying strategic ways to curb FMLA abuse and improve morale as termination was really the only disciplinary action discussed.

I would like to see presenter provide other options regarding disciplining employees who are abusing the frequency and duration of their approved intermittent FMLA leave other than doing an investigation. Have spoken to the employees and done the re-certification, would like some suggestion other than termination.

Would like to see more information and examples of lower level employees conduct outside the workplace, since this is a frequent issue in the workplace.
