Time off for a headache?  Intermittent leave for arthritis?  More so than ever, employees are requesting accommodations in the workplace for what arguably may be disabilities under the Americans With Disabilities Act.  This presentation will focus on what is and is not a disability under the ADA, comparing the ADA with the Family Medical Leave Act, and providing best practices and recommended policies to help handle the ADA’s required “interactive process” that employers must engage in when an employee requests an accommodation.  Professionals will also learn the dangers that can be caused  by failing to document the interactive process, and best practices to limit liability when things don’t go as planned.

Agenda:

  • Summary of Current ADA laws
  • Comparing and Contrasting ADA and FMLA
  • Understanding importance of interactive process
  • Effective use of interactive process and identifying best practices and policies
  • Hypothetical situations with examples
  • Question and Answer

I understand that the presenter may have been nervous, however I felt like she was stuttering her way through the presentation and not fully reading the slide so she misspoke several times throughout the session. That being said, I would have expected for the presenter to be an expert in the area, and was surprised that she was reading off the slides instead of paraphrasing and being able to speak based on her knowledge of the topic. If I'd known that she was going to just read the slides word for word, I would have just downloaded the presentation and read on my own time.

I thought the moderators comment about the names the EEOC used in their presentation was an odd comment. I assume the EEOC is trying to be inclusive of all backgrounds and would expect the moderator to recognize that.

The presenter was asked to 'field' questions due to 20 mins remaining - which they graciously accommodated and then several questions were submitted and the facilitator asked the presenter to essentially shorten their answers,,, Perhaps it would add value to post in the chat to have questions submitted during the 'open 20 mins' versus rushing responses now that the allotted time expired. Just a thought
